These Terms & Services govern all services provided by 5280 Metal Works LLC, a residential custom metalwork company based in Aurora, Colorado.
By approving an estimate, signing a proposal, authorizing work, or submitting payment, the client agrees to these Terms & Services in full.
5280 Metal Works LLC proudly serves homeowners in Aurora, CO, and nearby areas, including Centennial, Cherry Creek, Greenwood Village, Parker, Castle Rock, Castle Pines, The Pinery, Highlands Ranch, and surrounding communities.

5280 Metal Works LLC provides residential custom metalwork services, including railings, metal fabrication, welding, aluminum welding, iron work, gates, staircases, repairs, and specialty metal projects. All work is performed according to the details outlined in the written estimate or approved proposal and in compliance with applicable local requirements.

Only the services specifically described in the signed written estimate, proposal, or agreement are included in the scope of work. Any additional work, changes, upgrades, repairs, design modifications, or material changes must be approved in writing before work continues.
All estimates are provided in writing and are valid only for the period stated in the proposal.
Pricing may be adjusted if:
Permit fees, HOA fees, engineering fees, inspection fees, and third-party charges are not included unless clearly stated in writing.
A deposit may be required to secure scheduling, order materials, begin design or fabrication, or reserve shop time.
Payment schedules will be outlined in the signed estimate, proposal, or agreement. Depending on the project, payment terms may include:
Failure to make timely payments may result in project delay, project suspension, or additional collection action as permitted by law.
Final payment is due upon substantial completion unless otherwise stated in writing. Substantial completion means the contracted work is complete enough for its intended use, even if minor punch-list items remain.
Any change to the original scope of work must be documented and approved in writing.
Verbal requests are not binding unless confirmed in writing by 5280 Metal Works LLC.
Project timelines are estimates only. Fabrication and installation schedules may vary based on project complexity, material availability, weather, site readiness, and other factors outside the company’s reasonable control.
Delays may result from:
5280 Metal Works LLC is not responsible for delays caused by factors outside its reasonable control.
The client is responsible for securing HOA approval unless otherwise agreed in writing.
Permit responsibilities will be specified in the written agreement when applicable. Some railing, stair, structural, fencing, gate, or exterior metalwork projects may require permits, engineering review, inspections, or HOA approval depending on the property, city, neighborhood, or project scope.
Delays caused by city review, permit processing, HOA review, engineering requirements, or inspection scheduling are outside the company’s control.
If redesign, additional documentation, revised fabrication, or added labor is required because of permit, code, HOA, or inspection requirements, additional charges may apply.
Clients must disclose all known site conditions that may affect fabrication, installation, welding, repair, or access.
This includes:
5280 Metal Works LLC is not responsible for damage caused by undisclosed conditions, concealed defects, unsafe existing structures, unmarked utilities, or property conditions outside the company’s control.
Unforeseen conditions may require additional work at additional cost.
Custom metalwork is built to fit the approved project scope, measurements, design, and site conditions.
Certain material characteristics are normal and are not considered defects, including:
Exterior metalwork is exposed to Colorado weather, including sun, snow, ice, wind, moisture, and temperature swings. Proper maintenance may be required to preserve the finish and performance of railings, gates, fencing, stairs, and other exterior metal features.
5280 Metal Works LLC provides a limited workmanship warranty only as defined in the signed written agreement.
Manufacturer warranties may apply to certain materials, coatings, hardware, finishes, or third-party products when applicable.

Warranty claims must be submitted in writing. Photos, project details, and access to inspect the work may be required.
5280 Metal Works LLC shall not be liable for indirect, incidental, special, or consequential damages.
To the fullest extent allowed by law, liability is limited to the total contract value of the work performed by 5280 Metal Works LLC for the specific project at issue.

Failure to meet these responsibilities may delay the project or result in additional charges.
Deposits are non-refundable once materials are ordered, custom fabrication has begun, design work has started, or scheduling has been confirmed.
Custom-fabricated metalwork, special-order materials, custom coatings, custom finishes, and project-specific parts are non-refundable.
Cancellation after procurement, design, fabrication, or scheduling may result in charges for labor, materials, shop time, design time, restocking, handling, or completed work.
By providing your phone number to 5280 Metal Works LLC, you consent to receive SMS communications related to your inquiry or project. These messages may include appointment confirmations, scheduling updates, project notifications, and occasional service-related follow-ups. 5280 Metal Works LLC does not send unsolicited promotional messages without consent.
The parties agree to attempt good-faith resolution before pursuing legal action.
If a dispute arises, both parties agree to first communicate in writing and make reasonable efforts to resolve the matter directly.
If unresolved, disputes shall be subject to the laws and jurisdiction of the State of Colorado. Venue shall be in the appropriate Colorado court unless otherwise required by law.
Mediation may be pursued before litigation when appropriate.
All design plans, drawings, and renderings remain the property of 5280 Metal Works LLC until full payment is received.
Unauthorized reproduction or use is prohibited.
